China has released revised regulations on integrated-circuit layout designs, with the updated rules scheduled to take effect on October 15.
The revisions address originality requirements and supporting documentation, including clear drawings and statements of the protected design. They also clarify remedies for infringement, covering losses, infringers’ gains and reference to licensing fees.
Serious infringements may attract punitive damages under the framework. Provisions concerning licensing and rewards accompany the protection measures. For the semiconductor sector, the changes place greater emphasis on identifying what a registered layout protects and on the mechanisms available when those rights are infringed.
